In the interests of the safety and health of our clients and employees, as well as in order to continuously improve the quality of the services provided, please read the following regulations before using the services of our Salon.

SERVICE REGULATIONS in the XY STUDIO.

§ 1

General provisions

These regulations, hereinafter referred to as the "Regulations", specify the exact rules for using the services provided in the XY Studio at Łąkowa 35/38, Gdańsk 80-769, hereinafter referred to as the "Studio".
The Studio provides Services from Monday to Friday from 10:00 to 18:00.
Studio Clients are required to read the Regulations before booking a visit in the Studio. Joining the selected service means accepting these Regulations, without the need for the Client to sign them.
The Regulations together with the Price List and the description of Services constitute an agreement for the provision of services.

§ 2

Definitions

Client – ​​means a natural person, of full age, who has reached the age of 18 and has full legal capacity.
Underage – a client who has not reached the age of 18 and uses the Studio's services with the written consent of a parent/legal guardian.
Regulations – means these Regulations drawn up by the Service Provider.
Studio – means the Service Provider providing services in a given premises at the given address.
Service – means a service/treatment provided by the Service Provider to the Client.
Deposit – a form of securing the booking of a visit on a given date, payable in advance before the service is performed, deducted from the final price after the service is performed.

§ 3

Client's obligations

The Client of the Studio is an adult or an underage with the consent of a legal guardian. In the case of a Underage, the Studio is entitled to view the relevant consent of the legal guardian before the visit and to refuse to provide the Service in the absence of such consent.
The Client is obliged to provide information about their health condition, if it is necessary to make a decision on the performance of a specific service and to sign a declaration of the truthfulness of the information provided by completing and signing the required documentation.
Each Client is familiarized with the indications, contraindications, side effects and post-treatment recommendations and by starting the Treatment they are fully aware of them and accept them. Confirmation is a signed informed consent for the procedure by the client.
Each time the Procedure is performed again, the Client should confirm the current state of health and the information provided or update the medical information each time, especially contraindications. Before starting the procedure, you will also be required to complete a questionnaire regarding your health. In addition, it is the responsibility of each client to thoroughly familiarize themselves with the potential post-treatment consequences and the procedure for proper tattoo care. Our goal is to provide you with comprehensive care and satisfaction, which is why these steps are important for your safety and the best result. The studio is not responsible for allergies, sensitivities or other ailments - this should be consulted with a specialist.
Pregnant or breastfeeding women cannot use the tattoo procedure.
During the procedure, you should be sober and not under the influence of other intoxicants.

The client is obliged to immediately notify the person performing the procedure of a deterioration in their health during the Service.
Clients should come to the scheduled appointment without accompanying persons.
The Client should inform the Salon by phone in advance of any potential delay.

In the event of persistent cancellation of visits by the Client later than permitted by these regulations or failure to appear for an appointment without canceling the visit on the indicated date more than 3 times, the Salon is entitled to refuse to provide or book another visit for a given Client.

 

§ 4

Price list and booking an appointment

Tattoo prices are set individually. The initial price is PLN 330. The price of the tattoo provided by us is an approximate estimate, due to the fact that the final appearance of the design, as well as its final size, is selected together with the Client during their stay in the studio.
Before choosing the Service, the Client can familiarize themselves with its description, duration and price.
Full confirmation of the agreed date is made after the deposit is paid. This deposit is non-refundable in the absence of information about the cancellation of the session two weeks before the agreed date, or about changing the date a week before the set date. In other cases, we return it in the form of a voucher to be used in our studio. It is valid for one year from the date of issue. At the same time, we inform you that changes in the dates can be made a maximum of twice without losing the deposit.

If you have a voucher, it can be considered as a deposit and will be treated the same later. If the client does not show up for the agreed date, the deposit is forfeited and its value is deducted from the initial amount of the voucher.

The deposit is deducted from the final price of the tattoo.

As a Studio, we have the right to change the date you booked up to 1 business day before the booked date. We would also like to emphasize that we also reserve the right to refuse to carry out the procedure without having to provide a reason. In both cases, we will refund you the full amount of the deposit.
By paying a deposit or undergoing a treatment without a deposit, the client agrees to consciously perform the treatment and consciously accepts the above regulations. Before the planned visit, it is necessary for the tattooed area not to be tanned. In a situation where the skin in a given place is strongly tanned, we reserve the right to refuse to perform the treatment and the possibility of postponing the agreed date to a later date. Unfortunately, such a decision would involve the loss of the paid deposit.

 

§ 5

Booking appointments

1. The Studio books for visits via: e-mail, salon social media and telephone contact.
2. The Studio requires the Client to pay a deposit of PLN 216.
3. The Client can pay the deposit in person at the Salon or by transfer to the account number provided by the Studio.

4. The session date is set when registering.
5. Before the scheduled session, we recommend a free consultation in our studio to discuss the design, size, location and other details of the tattoo.
6. Tattoo prices are set individually. The initial price is 324 PLN. The price of the tattoo given by us is an approximate estimate, due to the fact that the final appearance of the design, as well as its final size, is selected together with the client during their stay in the studio.
7. Before the visit, the Client may familiarize themselves with its description, duration and price.
8. Confirmation of the agreed date is made after the deposit is paid. This deposit is non-refundable (in the event of a session being canceled by the artist or the Studio, it is subject to a 100% refund). The appointment date can be changed twice without losing the deposit, up to 7 days before the scheduled meeting. A change within a period shorter than 7 days from the scheduled treatment date results in the loss of the deposit and a new deposit is required when re-scheduling the appointment.
9. If you have a voucher, it can be considered a deposit and will be treated the same way later. If the client does not show up for the agreed date, the deposit is forfeited and its value is deducted from the initial amount of the voucher.
10. The deposit is deducted from the final price of the tattoo.
11. As a Studio, we have the right to change the date you have booked up to 1 business day prior to the booked date. We would also like to emphasize that we also reserve the right to refuse to carry out the procedure without having to provide a reason. In both cases, we will refund the full amount of the deposit.
12. By paying a deposit or undergoing the procedure without a deposit, the client consents to consciously perform the procedure and consciously accepts the above regulations.
13. The artist has the right to change the session date if he considers that:
- there are changes on the body that prevent the tattoo from being done correctly, e.g. tan, skin disease, skin irritation.*
- the physical condition of the client or their skin prevents the procedure from being done correctly; *
*(changing the date not due to the artist's fault is equivalent to losing the deposit).
14. In the case of the Service, the Deposit is included in the price of the Service performed for the Client. The final price settled after the Service is performed will be reduced by the amount of the Deposit paid. For the purposes of these Regulations, “Force Majeure” means any event beyond the control of the Salon, including, but not limited to, an act of God, an epidemic and pandemic, war, insurrection, civil unrest, riots, acts of terrorism, fire, explosion, flood, theft or failure of essential equipment, intentional damage affecting the work of the Salon, strike, lock-out, weather conditions, acts and regulations of state or local government bodies, sudden shutdown of media in the Salon. The Salon shall not be liable to the Client for failure to perform any obligations arising from these Regulations to the extent that it is caused by the occurrence of Force Majeure. In such a situation, the Client will be given the opportunity to choose: booking another available date, refund of the Deposit paid or receiving a voucher in the amount of the Deposit paid to be used in accordance with the established expiry date.

§ 6

On the day of the visit

1. The tattoo design is shown on the day of the session.

2. Keep in mind that a tattoo is art performed on the skin, which is a difficult and variable "material". Many factors have an impact on the final effect, including the individual characteristics of your skin, such as age, its elasticity, type, and any diseases or allergies that may not be detected. The place where the tattoo is performed also has an impact on the result. Proper skin care after the procedure is also a key aspect. It is particularly important to follow the rules provided by the tattoo artist and included in the annex to the "Aftercare" regulations, which you agree to comply with. It is important to remember that improper aftercare can significantly affect the healing process of the skin and the final effect of the tattoo. That is why it is so important that you follow the aftercare instructions that you will receive from your tattoo artist in order to achieve the best possible result. 

3. During the procedure, clothing may become dirty with ink, blood or tracing paper. We try to protect everything, but there is still a risk. Therefore, we advise you to dress appropriately for the session or bring clothes to change into. A change of shoes is also required in the studio. Flip-flops are available on site, but if you have your favorites, please bring them. 

4. In a situation where the tattoo requires exposing a larger area of ​​the body, the client has the right to ask for the treatment area to be separated using a screen in order to maintain privacy and comfort. However, due to the appropriate tension of the skin in the area where the tattoo is to be located, the tattoo artist may ask you to remove an appropriate part of your clothing or underwear. This is important to enable effective work and the best possible result during the tattoo. It is worth considering that the tattoo artist will take care to maintain professionalism and maintain the client's privacy to the extent possible. 

5. The designs we make are our own designs, prepared based on your inspirations, tips, suggestions and submitted materials. Your unique design is created with your participation during the first session, and until the final acceptance, you can suggest your artist to make changes to the design. 

6. We schedule all-day sessions at 10:00, and any consultations always between 9:00 and 10:00 to be able to devote an appropriate amount of time to both the consulted and the tattooed. 

7. The tattoo artist has the right to take photos of the finished tattoo, without directly showing the client's face. The photos taken may be published on social media (Facebook, Instagram, TikTok).

8.  Remember to strictly follow your artist's recommendations regarding the care of your freshly made tattoo. After the session, you will receive a leaflet with tips from us.

 

§ 7

Guest artists and former collaborators

1. If the tattoo was done by a guest tattoo artist, the studio is not responsible for the tattoo. If any corrections are necessary, please contact the tattooist directly. 

2. If the tattoo was done or started by a tattooist who has already ended cooperation with our studio, please contact the artist directly to correct or complete the started design. XY Studio is not responsible for any problems in contact with an artist who no longer cooperates with the studio.

§ 8

Payment

The Client is obliged to pay for the Services performed immediately after their completion.
The Studio offers the following payment methods:
- Cash
- Bank transfer
- Blik
The Service Provider reserves the right to introduce temporary promotions, gift vouchers or service packages. The rules regarding their purchase and duration will be regulated in a separate annex to these Regulations. 

Promotions cannot be combined.

§ 9

Vouchers

1. A tattoo voucher can be purchased in our studio. It is possible to buy it in person at the studio for cash or you can contact us by e-mail, and after completing all formalities and posting the payment (voucher amount + shipping), it will be sent by post to the address provided. 

2. The purchased voucher is a voucher for XY studio, not for a specific artist. 

3. A voucher purchased from our studio is non-refundable and is valid for 12 months from the date of purchase. If for some reason the person who received the voucher wants to cancel the tattoo, they can contact the studio directly and transfer the voucher to another person. All other cases will be considered individually.

§ 10

Hygiene and safety - salon standards

The Studio declares that all employees are properly trained and experienced, have current health tests and perform the Services at the highest level and with due diligence.
Before starting the Service, the Employee is obliged to properly prepare their workstation and ensure proper disinfection performed before each Client.
The Employee is obliged to perform the procedure correctly in accordance with the applicable procedures and in accordance with professional practice, while maintaining appropriate hygienic and sanitary conditions and health and safety and fire protection regulations.
The Studio uses disposable applicators and disinfected accessories and tools.
The Studio only uses disinfection preparations approved for use and required by the sanitary inspection, in accordance with the applicable regulations and standards.
The Studio, taking care of the hygiene and safety of customers with the utmost care and compliance with hygienic and sanitary procedures, uses appropriate certified disinfection preparations and sterilization devices (autoclave).
In the event of a Client being injured during the Procedure, the Procedure is immediately interrupted, the post-exposure procedure is initiated, and the injured area is immediately washed, disinfected, and secured with a sterile dressing appropriate to the extent of the injury. The interrupted Procedure is completed, if possible, after securing the injured area or at another time convenient for the Client.

§ 11

Studio Obligations

1. Before performing the Service, the Studio is obliged to:

- conduct an interview with the Client regarding their expectations and health condition and collect from the Client a completed and signed Client card/consent to the procedure,
- present the Client with any contraindications to performing the Service and any recommendations after the service,
- inform the Client about the real effects of the procedure, the number of procedures needed to achieve the intended effect, about any side effects or complications after the procedure, about the preparations used for the procedure,
- comply with the principles of hygiene and safety during the performance of the Services in accordance with sanitary, treatment and health and safety procedures,
- take photos before and after the procedure for the treatment documentation.

2. The Studio reserves the right to change the Regulations for important reasons, i.e. changes in legal regulations, changes in payment methods, changes in the provision of services - to the extent to which these changes affect the implementation of the provisions of these Regulations. The new regulations enter into force on the date of introduction of the changes. The Studio undertakes to inform all clients with booked appointments about changes to the Regulations before the services are performed.

3. In the event of any doubts regarding the safety of the procedure, the Studio reserves the right to refuse to perform the procedure.

§ 12

Final Provisions

Each Client has the right to inspect the Regulations to which the Service Provider refers as to their own experience.
The current Studio Regulations are available in the Studio in a place visible and accessible to Clients.
For any damage to the Studio's equipment by the Client, Clients are liable without limitation in accordance with Article 415 of the Civil Code. Their statutory representatives are liable for damage caused by underage.
The Studio is not liable for any items left in outerwear or in the Studio outside the places designated for leaving them, in particular valuables, bags, backpacks and handbags, which the Client should keep with them.
Throughout the entire Studio, there is a total ban on smoking and using tobacco and tobacco and nicotine products, including electronic cigarettes, as well as a total ban on consuming alcoholic beverages and other types of stimulants and intoxicants. It is forbidden to eat in the place where the tattoo is performed (the ban does not apply to beverages).
It is forbidden to bring animals to the Studio.
Any disputes arising from the Services provided should be resolved amicably in the first instance. In the event of failure to reach an agreement, disputes will be resolved by a court of general jurisdiction.

If any provision of these regulations is deemed invalid, inconsistent with the provisions of the law or unenforceable, it will be excluded from the provisions of these regulations, which will continue to apply to the fullest extent permitted by law.

§ 13

Processing of personal data of customers

By booking a visit at the Studio the customer consents to the processing of their personal data for the purposes described below, in this paragraph.

The personal data of Clients obtained in connection with the use of the Salon's services will be processed for the following purposes:

for the purpose of communication with the client (receiving information about planned visits via mobile phone and e-mail) and for the purpose of performing the service.

The legal basis for processing Client data will be: granted consent, necessity to perform the contract or to take action at the Client's request before concluding the contract, necessity to fulfill the legal obligation incumbent on the administrator, necessity for the purposes resulting from legally justified interests pursued by the administrator, e.g. such as responding to letters and requests from Clients.

Customer data may be transferred to the following entities: processors (processing entities) in connection with activities ordered by the Studio, entities authorized under the provisions of law, control and supervisory entities, enforcement authorities, courier companies that will deliver parcels to Customers, Customer data will be transferred to a third country (e.g. the USA) in connection with activities conducted on Facebook (customers contacting the studio's fanpage on Facebook or Instagram).

The period of processing of Customers' personal data depends on the purpose for which the data is processed. The period for which personal data will be stored is calculated based on the following criteria: legal regulations that may oblige the Studio to process data for a specified period (e.g. we store data on invoices for 5 years from the end of the last accounting year), the period that is necessary to defend the interests of the Studio and the period for which consent was granted.

In addition, we inform you that Customers have the right to: request access to their personal data, rectify their data, request supplementation of incomplete personal data, including by submitting an additional statement, deletion of their data or restriction of their processing, objection to further processing of their personal data, transfer of their personal data. However, in exceptional situations, data cannot be deleted immediately. These are:

- data that is necessary to provide the service and a possible complaint period,

- data for which there are legal grounds to continue processing despite this,

- data processed in accordance with other legal regulations.

Customers have the right to withdraw their consent at any time. Withdrawal of consent does not affect the lawfulness of data processing based on the consent granted before its withdrawal.

In case of doubts as to the correctness of the processing of personal data by the Studio, Customers have the right to lodge a complaint with the supervisory authority. The Customer's personal data is processed in accordance with the above content and for the purposes indicated in the above information clause, which the Customer also reads during their first visit to the Salon.

When deciding to have a tattoo done at XY studio, the Customer is obliged to read the studio's regulations, thereby accepting its terms.

STUDIO IS NOT RESPONSIBLE FOR PERSONAL ARRANGEMENTS BETWEEN THE CUSTOMER AND THE TATTOO ARTIST, WHICH VIOLATE THE CONTENT OF THESE REGULATIONS.
